Judicial reviews around the Accountable Care Organisation (ACO) contract

The High Court found in favour of NHS England in the judicial review brought by a campaign group, 999 Call for the NHS, who challenged the lawfulness of the payment mechanism in the draft ACO contract.

In the second of two judicial reviews a High Court judge has dismissed the challenge backed by the late Professor Stephen Hawking and the British Medical Association. He concluded that the ACO policy (as defined) is within the power of the Secretary of State and NHS England to propose and to base a consultation upon, and it is lawful for CCGs to adopt and apply.
